Michael, of counsel to the firm, is a seasoned attorney with concentrations in professional malpractice and commercial litigation as well as consumer protection, environmental and real estate law. He has defended licensed professionals in more than 100 state and federal actions alleging negligence. He also handles commercial disputes and claims made under the New Jersey Consumer Fraud Act (NJCFA). In addition, he brings a high level of knowledge and expertise to matters involving real estate brokers, title companies, mortgage companies, insurance companies and home inspection companies. In that aspect of his practice, he handles Real Estate Settlements Procedures Act (RESPA), Truth in Lending Act (TILA) and related cases.

Michael, who served as a U.S. Army captain between college and law school, began his practice working in criminal defense, gaining valuable trial experience.

  • Successfully represented a large mortgage company in a borrower’s suit alleging RESPA, TILA and NJCFA violations in a refinancing.
  • Obtained summary judgment against a plaintiff who sued a real estate broker and its agents over the sale of a home alleged to contain toxic mold.
  • Obtained summary judgment against a plaintiff who claimed a real estate broker and its agents misrepresented the home’s condition, in violation of the NJCFA.
  • Obtained dismissal of two separate actions against real estate brokers and their agents for dog bites to social guests of the tenants/dog owners.
  • Obtained dismissal in a malpractice case against an insurance broker for the alleged failure to provide adequate counsel and advice relating to commercial construction.
  • Obtained dismissal of a malpractice case that alleged a title insurance broker negligently failed to identify the correct parcel of land or pay the correct amount of taxes and liens at closing.
  • Obtained a dismissal of a class action lawsuit against a title insurance broker alleged to have withheld funds above and beyond costs incurred at closing.
  • Successfully defended an adverse possession action against owners of a commercial property by adjoining landowners.
  • Successfully defended a multinational corporation in a products liability matter over a component part of a refinery.
  • Successfully defended a multinational corporation in a products liability matter over a component in an envelope-producing machine.
  • Negotiated contracts related to interstate and international sale, transportation and cryo-storage of donor human ova for use in fertility clinics.
